12 Conrail Supplemental Pension Program AGREEMENT ENTERED INTO THIS 14 DAY OF OCTOBER, 1987, AMENDING THE AGREEMENT, MADE OCTOBER 14, 1982, BETWEEN THE EMPLOYEES REPRESENTED BY THE BROTHERHOOD OF LOCOMOTIVE ENGINEERS AND NJ TRANSIT RAIL OPERATIONS (NJTRO) AND CONSOLIDATED RAIL CORPORATION (CONRAIL) PURSUANT TO SECTION 1165 OF THE NORTHEAST RAIL SERVICE ACT. WHEREAS, the Section 1165 Agreement, dated October 14, 1982, provides that the standing of NJTRO Passenger Engineers on the NJTRO Order Selection List/Seniority Roster is based on their Conrail Seniority; and WHEREAS, NJTRO Passenger Engineers who have no Conrail seniority would be placed on the Order Selection List/Seniority Roster behind all Passenger Engineers with Conrail Seniority prior to January 1, 1983; and WHEREAS, certain NJTRO Passenger Engineers who belong to the Conrail Supplemental Pension Program desire to voluntarily terminate their Conrail seniority in order to eliminate any adverse impact on their Conrail Supplemental Pension benefits; IT IS AGREED that Section 1165 Agreement will be amended to provide that: A. NJTRO Passenger Engineers who are participants in the Conrail Supplemental Pension Program may voluntarily resign from Conrail terminating their Conrail seniority, and such Passenger Engineers will retain their relative standing on the NJTRO Order Selection List/Seniority Roster based on their former Conrail seniority. B. NJTRO Passenger Engineers terminating their Conrail seniority in accordance with Paragraph A will be treated as though their Conrail seniority continues to exist; however, such Passenger Engineers will forfeit those rights to exercise Conrail seniority contained in Articles V and VII of the Section 1165 Agreement. C. NJTRO Passenger Engineers desiring to terminate their Conrail seniority and to retain their relative NJTRO Order Selection List/Seniority Roster standing must notify in writing the highest appeals officer of both NJTRO and Conrail prior to terminating their Conrail seniority. Position AGREEMENT BETWEEN NEW JERSEY TRANSIT RAIL OPERATIONS, INC. AND ITS EMPLOYEES REPRESENTED BY THE BROTHERHOOD OF LOCOMOTIVE ENGINEERS. 1. Effective upon ratification of the Collective Bargaining Agreement dated January 27, 1989, Hostlers will be reclassified and will be called Assistant Engineers. 2. Work presently accruing to Hostlers will become the exclusive work or Assistant Engineers. 3. Effective upon ratification of the Collective Bargaining Agreement dated January 27, 1989, the roster of Assistant Engineers will be placed on the bottom of the Engineers Roster. Employees on the Assistant Engineers Roster (formerly Hostlers) will have prior rights to all Assistant Engineers (formerly Hostlers) positions and will acquire seniority as Engineers only as provided in the Agreement dated January 27, 1989, amending Rule 12, Seniority, for participants in the Locomotive Engineer Training Program. Engineers on the existing Engineers Seniority Roster will have prior rights to all engineer positions and will acquire rights as Assistant Engineers (formerly Hostlers). 4. Subsequent to the date of this agreement, all engine service employees hired will be placed on the single roster established under Section 3 of the agreement in accordance with Rule 12 - Seniority who are not subject to NJ Transit Rail's Locomotive Engineer Training Program (LETP). 5. Employees on the Assistant Engineer (formerly Hostler) Roster will be given the necessary training and an opportunity to take the required promotion examination. If the employees referred to in this section refuse to take the training or examination, they will be confined to Assistant Engineer (formerly Hostler) positions. 6. Assignment to Engineer or Assistant Engineer positions will be on the basis of the roster established in Section 3 of this agreement subject to the prior rights of that section, except that qualified engineers shall not be permitted to hold Assistant Engineer (formerly Hostler) positions when there are not enough qualified engineers to cover engineer regular assignments and extra lists. 7. This Agreement will amend Engineers and Assistant Engineers Rule 1(a.), Scope and Definitions according to the extent so provided for in Section (3) and (6) of this Agreement. Appendix 15 Atlantic City Agreement Whereas New Jersey Transit Rail Operations will begin operating train service on the Atlantic City Rail Line on or about September 17, 1989 it is agreed that: The agreement dated January 1, 1983, between the BLE and NJTROI as amended is applicable to all service performed on any train on any line of the railroad operated by NJTRO, Inc. The Existing Agreement between the BLE and NJTRO is interpreted to mean as follows for the new Atlantic City Rail Line: HOME TERMINAL The Home Terminal will be in Atlantic City and crew facilities as per Rule 36 will be maintained. Parking will be provided for each Engineer at the Home Terminal facility. EXTRA LISTS The Extra Lists will be established and maintained at the Home Terminal in Atlantic City. All vacancies will be covered by Engineers registered on the Atlantic City Extra Lists. When the Atlantic City Extra List is exhausted, Engineers will be called from the following lists in this order: 1st the Trenton Extra Lists, 2nd the Long Branch Extra Lists, 3rd the New York Extra Lists, 4th the Hoboken Extra Lists. Deadhead and expenses will be paid as follows: TRENTON Anyone called off the Trenton Extra Lists will be paid three (3) hours in each direction at the applicable pro rata rate of pay for each tour of duty. Gas miles will be paid plus any tolls when receipts are submitted for each tour of duty. LONG BRANCH Anyone called off the Long Branch Extra Lists will be paid three (3) hours in each direction at the applicable pro rata rate of pay for each tour of duty. Gas miles will be paid plus any tolls when receipts are submitted for each tour of duty. NEW YORK Anyone called off the New York Extra Lists will be paid four (4) hours in each direction at the applicable pro rata rate of pay for each tour of duty. Gas miles will be paid plus any tolls when receipts are submitted for each tour of duty. HOBOKEN Anyone called off the Hoboken Extra Lists will be paid four (4) hours in each direction at the applicable pro rata rate of pay for each tour of duty. Gas miles will be paid plus any tolls when receipts are submitted for each tour of duty. Train and Engine crews will go on and off duty at the same time. The on and off duty times will be as are in effect at Trenton, N. J. on the day service commences. CALLING TIME Extra Engineers called off the Atlantic City Extra Lists will be called at least four (4) hours in advance of the on duty time. Engineers who wish to mark off from an assignment must do so at least five (5) hours in advance of starting time for their assignment. Engineers resuming after having been off must report back on at least five (5) hours in advance of starting time for their assignment. Extra Engineers called off any other lists will be called at least four (4) hours before starting time. ATTENDING BOOK OF RULES, ETC. Engineers who are required to attend any Book of Rules Classes, Training Classes, etc., that are held outside of Atlantic City will be paid the earning of their assignment or the assignment for which they stood, if no time is lost they will be paid a minimum day. They will also be paid the deadhead allowance and car miles as specified in this agreement. BLE Representative representing BLE members at hearing or investigations held in Atlantic City will be paid the earnings of their assignment or the assignment for which they stood, if no time is lost they will be paid a minimum day. They will also be paid the deadhead allowance and car miles as specified in this agreement. QUALIFYING ON PHYSICAL CHARACTERISTICS Any Engineer who bids to and is awarded a position that performs service on the Atlantic City Line, who is force assigned or who displaces to a position that performs service on the Atlantic City Line will be paid to qualify, from this date up to and including February 28, 1991. BULLETIN AND AWARDS All initial assignments will be bulletined and awarded before August 15, 1989. The successful bidders will be qualified and paid as per this agreement. The assignments that are vacated by this process will not be advertised until the initial successful bidders enter service on the Atlantic City Line. Rule 32, Paragraph "i", applies to successful bidders. PAY FOR QUALIFYING Pay will be allowed up to fifteen (15) days form Trenton to Philadelphia and four (4) days from Philadelphia to Atlantic City. Engineers qualifying will be paid the earnings of their assignment or the assignment for which they stood with a minimum of one (1) day plus two (2) hours at the overtime rate. Should no time be lost they will be paid one (1) day plus two (2) hours at the overtime rate. Time spent qualifying after having been paid forty (40) straight time hours will be paid at time and one-half with a minimum of ten (10) hours. This allowance will be paid to those Engineers who qualify from this date up to and including February 28, 1991. GENERAL NJTRO may start immediately to qualify Engineers on all extra lists. Abbott General Chairman, Brotherhood of Locomotive Engineers 201 Avenue "I" Matamoras, PA 18336 File: 141 Dear Mr. Abbott: It is agreed, when qualified Engineers operate trains between Penn Station, New York and Sunnyside Yard, Queens, New York, the following shall govern: a.) The Engineers manning trains in service between Penn Station, N.Y. and Sunnyside Yard, Queens, Long Island, N. Y. and Sunnyside Yard and Penn Station, N.Y. will be paid one (1) hour at the pro rata rate of pay in addition to all other allowances paid for each tour of duty. There shall be only one such payment made during any tour of duty, regardless of the number of trips between the above two locations which may be made during that tour of duty. b.) It is agreed and understood that any payment as described above applies exclusively to those movements between Penn Station, N.Y. and Sunnyside Yard, Queens, N.Y. or to any points between the two (2) named points. c.) This agreement will become null and void if NJ Transit establishes and maintains a terminal at Sunnyside Yard, Queens, Long Island, N.Y.
