Godwin, General Chairman Brotherhood of Locomotive Engineers 97 South Buffalo Road Hamburg, New Jersey 14075 Dear Sir: During the negotiations which concluded in the collective bargaining agreement effective July 1, 1985, the parties engaged in extensive discussions regarding the legality of an exclusive representation provision, such as the clause contained in the current agreement between the United Transportation Union (T) and NJTROI. After review and consultation, we have advised our client, NJTROI, that such a provision would likely be deemed unlawful under the Railway Labor Act, 45 U.S.C. Abbott General Chairman, Brotherhood of Locomotive Engineers 201 Avenue "I" Matamoras, PA 18336 File: L-141-BLE Dear Mr. Abbott: This letter sets forth our mutual understanding between the Brotherhood of Locomotive Engineers (BLE) and NJ TRANSIT Rail Operations, Inc. (NJTROI) concerning the dispatch and operation of engines equipped with an air conditioned engine control compartment or compartments. As discussed, NJTROI will, at its sole discretion, acquire through purchase, rental or lease, new, used, remanufactured or rebuilt diesel-electric, electric or any other engine equipped with air conditioned engine control compartment or compartments. The same option will extend to engines currently rostered by NJTROI that are modified, rebuilt or remanufactured either by the Carrier or its agents. It is also understood that NJTROI will make a good faith effort to maintain engine control compartment air conditioners in proper working order, however, the dispatch of an engine equipped with an engine control compartment air conditioner that is non-functioning or the failure of an air conditioning unit while an engine so equipped is in transit will not constitute grounds for Engineers working under the provisions of the Collective Bargaining Agreement to refuse to operate said engine.
